Renovation contract: What to include and why

Before starting your home renovation project, make sure you sign a well-written contract with clear warranties and legal protections. These two elements are your best protection if a problem arises during your renovation or construction work. Here’s what you need to know.

Home improvement contract: What elements should be included?

The clearer and more detailed your contract is, the more written proof and legal arguments you have if you need to take action later. Here are the key details that must be included in a proper renovation contract: 

  • Your full contact information. 

  • Start and end dates for the renovation work. Make sure the contract states: “The work will be completed on or before (date), otherwise the contractor agrees to return the deposit.” 

  • Whether debris removal and job-site cleaning are included. 

  • A declaration confirming that the contractor agrees to comply with municipal bylaws and the National Building Code standards. 

Next, clearly outline every step of the renovation work, even for minor home improvements: 

  • product brands to be used 

  • colours 

  • finishes 

  • sizes and formats, etc. 

Include all plans, drawings or technical specifications, for example if an architect or technologist was hired for your renovation project.

What renovation warranties exist?

Specific renovation warranty programs are optional for renovation contractors. However, this does not mean that you have no protection during the renovation process. 

There are two types of renovation warranties: 

  1. Legal warranties 

  2. Warranties from renovation association programs 

Legal warranties and manufacturer warranties

Manufacturers of construction materials, appliances and accessories must legally provide a product warranty. These warranties apply automatically and free of charge. Make sure to ask for renovation documentation proving these warranties.

Some contractor associations offer structured and recognized renovation warranty programs, including: 

Are renovation warranties transferable?

Yes. Product or renovation warranties apply to the property, not the owner. If you sell your house, the warranty is automatically transferred to the new owner. 

What to do in case of a renovation dispute?

If you have a conflict or dispute with your contractor, first try to reach an amicable agreement. Here are your official options: 

  • Formal notice 

  • Legal action in court 

  • Small Claims Court for amounts under $15,000 

  • Superior Court or Court of Quebec for larger amounts 

  • Formal complaint with: 

  • Office de la protection du consommateur 

  • Régie du bâtiment du Québec 

  • Appropriate professional order 

Inspections before and after renovation work

Monitor project progress, take notes and photos, and only officially accept completed work once properly inspected. If in doubt, contact a certified home inspection expert. 

How to find a reliable contractor for your renovation projec

Before hiring a contractor, ask for recommendations from family, friends, or acquaintances who completed similar work.
